7.24.010 Mandatory sentences upon conviction of certain traffic violations.
Any person who, while under the influence of intoxicating liquor or narcotic drugs operates or drives any automobile, motorcycle or other motor vehicle upon any public street or highway within the City, or shall sit behind the wheel of a vehicle drunk or under the influence of narcotic drugs, shall, upon conviction thereof be punished as follows:
a. First Offense: A fine of not less than three hundred dollars of which one hundred dollars may be suspended and suspension of the offender's driver's license for a period of thirty days during which period, however, limited driving privileges may be allowed during daylight hours for the purpose of going to and from a place of employment.
b. Second Offense: Not less than five days in jail, and a fine of not less than five hundred dollars and suspension of the offender's driver's license for a period of one year with retention of driving privileges at the Court's discretion as set forth in subsection (a). (Prior code 12-300.1).
