RESOLUTION 10-42

A RESOLUTION OF THE CITY COUNCIL OF HOMER, ALASKA, AMENDING KACHEMAK DRIVE (PHASE II) WATER AND SEWER IMPROVEMENT ASSESSMENT ROLL BY EXEMPTING GOVERNMENT LOT 51 WEST OF KACHEMAK DRIVE, KENAI PENINSULA BOROUGH PARCEL NO. 179-100-17 OWNED BY KACHEMAK MOOSE HABITAT, INC.

WHEREAS, Resolution 05-81(S) was adopted by Council on July 25, 2005 authorizing the formation of the Kachemak Drive Phase II Water and Sewer Improvement District; and

WHEREAS, Pursuant to Resolution 05-50(A) which states the Council can exempt certain lands that will not be developed due to conservation easements or owned by organizations that conserve land for public purposes and or habitat protection from the Homer Accelerated Water and Sewer Program Assessment District Assessments on a case by case basis; and

WHEREAS, Government Lot 51 west of Kachemak Drive, KPB Parcel No. 179-100-17, is owned by Kachemak Moose Habitat, Inc., a small nonprofit that has preserved more than 630 acres of moose habitat on the Southern Kenai Peninsula since 1996; and
WHEREAS, Kachemak Moose Habitat, Inc. has an emphasis on conserving land around Beluga Lake next to the Homer Airport Critical Habitat Area; and

WHEREAS, During tough winters and deep snow the moose congregate in the Beluga Lake wetlands near the airport to feed and rest.

NOW, THEREFORE, BE IT RESOLVED that Government Lot 51 west of Kachemak Drive, KPB Parcel No. 179-100-17 will be exempt from an assessment from the Kachemak Drive (Phase II) Water and Sewer Assessment District until such time as the lot is developed or a permanent structure is constructed on the lot.
