RESOLUTION 10-69

A RESOLUTION OF THE CITY COUNCIL OF HOMER, ALASKA, APPROVING A TRANSFER OF RESPONSIBILITY AGREEMENT (TORA) BETWEEN THE STATE OF ALASKA AND THE CITY OF HOMER REGARDING MANAGEMENT AND ENFORCEMENT OF PARKING, LOADING ZONES, PEDESTRIAN CROSSINGS, AND SEASONAL SPEED ZONES WITHIN THE STERLING HIGHWAY RIGHT OF WAY ON THE HOMER SPIT.

WHEREAS, Traffic, parking, and pedestrian safety on the Homer Spit, particularly that portion of the Sterling Highway between Freight Dock Road and Fish Dock Road, has been identified as an area of serious concern; and

WHEREAS, The Sterling Highway is a state owned and maintained roadway; and

WHEREAS, The Homer City Council adopted Resolution 08-81 requesting that parking management and enforcement authority between Freight Dock Road and Fish Dock Road be delegated to the City; and

WHEREAS, The Department of Transportation and Public Facilities (DOT/PF) and the City both recognize the need to address management of parking, loading zones, seasonal speed zones, pedestrian crossings, and related signage on the Homer Spit for the benefit of the community and the traveling public; and

WHEREAS, DOT/PF has prepared a draft Transfer of Responsibility Agreement (TORA) which addresses parking, loading zone designations, seasonal speed zones, and pedestrian crossings within that portion of the Sterling Highway right-of-way from its intersection at Kachemak Drive southerly to the end of the Sterling Highway right of way at the end of the Spit.

NOW, THEREFORE, BE IT RESOLVED that the Homer City Council hereby approves the draft TORA, a copy of which is attached and incorporated herein, and authorizes the City Manager to execute the appropriate documents and proceed accordingly.
