RESOLUTION 11-111

A RESOLUTION OF THE CITY COUNCIL OF HOMER, ALASKA, APPROVING A TWO YEAR EXTENSION TO THE CURRENT AGREEMENT FOR PROFESSIONAL SERVICES WITH COASTAL ANIMAL CARE AT THE CURRENT ANNUAL COMPENSATION OF $123,800 FOR OPERATION AND MAINTENANCE OF THE HOMER ANIMAL SHELTER.

WHEREAS, The Agreement for Professional Services between the City of Homer and Coastal Animal Care for maintenance and operation of the Homer Animal Shelter expires on December 31, 2011; and

WHEREAS, Section 4 of the Agreement states “This contract may be extended upon written amendment expressing the mutual agreement of both the City and the Contractor. The renewal shall extend this contract for not more than one additional two year term from the preceding expiration date”; and

WHEREAS, Sherry Bess dba Coastal Animal Care submitted a letter to the City dated June 20, 2011 expressing her desire to exercise the renewal / extension option and later informed the Chief of Police that she was willing to waive the 5% annual fee increase contained in the Agreement and exercise the option at the current annual compensation of $123,800; and

WHEREAS, The Chief of Police recommends that it is in the best interest of the City to extend the contract for another two years at the present compensation.

NOW, THEREFORE, BE IT RESOLVED that the Homer City Council hereby approves a two year extension of the Agreement for Professional Services at the current annual compensation of $123,800 and authorizes the City Manager to execute the necessary contract amendment.

PASSED AND ADOPTED by the Homer City Council this 12th day of December, 2011.
