RESOLUTION 12-099

A RESOLUTION OF THE CITY COUNCIL OF HOMER, ALASKA, APPROVING A MEMORANDUM OF AGREEMENT BETWEEN THE HOMER PLAYGROUND PROJECT (HoPP), THE HOMER FOUNDATION, AND THE CITY OF HOMER REGARDING FUTURE MAINTENANCE AND OVERSIGHT RESPONSIBILITIES FOR THE NEW PLAYGROUND AT KAREN A. HORNADAY HILLSIDE PARK.

WHEREAS, HoPP is an ad-hoc organization which was formed for the specific purpose of building a new playground at Karen A. Hornaday Hillside Park; and

WHEREAS, HoPP very successfully coordinated all aspects of the playground project including planning, design, community involvement, procurement, and construction; and

WHEREAS, The playground project is complete and there was a grand opening and community celebration on May 27, 2012; and

WHEREAS, HoPP wishes to continue on as an organization and play an active role in support of playground maintenance and operations and it has volunteer and financial resources that it can devote to this effort; and

WHEREAS, A previous MOA between the parties dated June 30, 2011 was focused on the design and construction phase of the project and the parties agree that the requirements of that MOA have been satisfied in full; and

WHEREAS, It would be beneficial for the parties to enter into a new MOA which establishes and formalizes the roles and responsibilities of the parties with respect to maintenance, operations, and oversight of the new playground.

NOW, THEREFORE, BE IT RESOLVED that the Homer City Council hereby approves the Memorandum of Understanding between HoPP, the Homer Foundation, and the City of Homer regarding future maintenance and oversight responsibilities for the new playground at Karen A. Hornaday Park; a copy of which is attached and incorporated herein.
BE IT FURTHER RESOLVED that the City Manager is authorized to execute all appropriate documents.
