RESOLUTION 12-103(A)

A RESOLUTION OF THE CITY COUNCIL OF HOMER, ALASKA, AUTHORIZING THE CITY MANAGER TO ENTER INTO A NEW SHORT TERM LEASE WITH THE HOMER BOYS AND CLUB AND TO EXTEND THE CLUB’S OCCUPANCY OF THE LOWER LEVEL OF THE HOMER EDUCATION AND RECREATION COMPLEX (HERC) BUILDING FOR ONE ADDITIONAL YEAR BEGINNING ON JANUARY 1, 2013 AND ENDING DECEMBER 31, 2013.

WHEREAS, The City of Homer entered into a Lease and Security Agreement with the Homer Boys and Girls Club dated January 1, 2012; and

WHEREAS, The City Council approved a Lease Extension and Amendment in May of 2012 through adoption of Resolution 12- 046(A); and

WHEREAS, The current lease expires on December 31, 2012; and

WHEREAS, The Homer Boys and Girls Club provides a valuable service to the community, the current facility is ideal for its programs, and no other suitable facility or location has been identified; and

WHEREAS, The City Council has added renovation of this building to its Capital Improvement Program Priority List, authorized a Community Development Block Grant application to upgrade the area occupied by the Club, and appropriated funds to conduct an engineering analysis of code upgrades that would be required for new or different occupancies in the building; and

WHEREAS, Since the building must be heated minimally in any event, it makes sense to extend the Boys and Girls Club occupancy for another year until a long term use and plan for the facility can be developed.

NOW, THEREFORE, BE IT RESOLVED that the Homer City Council finds that it is in the best interest of the City to enter into another short term, one year lease with the Homer Boys and Girls Club and to allow that program to continue while a longer term solution for the building is developed.
BE IT FURTHER RESOLVED that the Council authorizes the City Manager to enter into a new short term lease with the Homer Boys and Girls Club and to extend its occupancy of the lower level of the HERC Building for one year beginning on January 1, 2013 and ending on December 31, 2013 at a rental rate of $750.00 per month.

BE IT FURTHER RESOLVED that the approval of this contract will be contingent upon the approval by the Fire Marshal for the continued use of the building by the Boys and Girls Club.
