A RESOLUTION OF THE CITY COUNCIL OF HOMER, ALASKA, REQUESTING THE UNITED STATES ATTORNEY GENERAL TO ISSUE A FINAL ORDER THAT REMOVES MARIJUANA FROM SCHEDULE I OF CONTROLLED SUBSTANCES UNDER THE FEDERAL CONTROLLED SUBSTANCES ACT OF 1970. 

 

               WHEREAS, Marijuana is now legal in the State of Alaska, Colorado, Washington, Oregon, the District of Columbia, and Guam; and

 

               WHEREAS, Seventeen additional states have pending legislation to legalize or decriminalize marijuana before them in 2016; and

 

               WHEREAS, This legislation creates opportunities for a new category of businesses to be created who are unable to function under such standard operating procedures for businesses such as opening bank accounts, taking advantage of business related tax incentives and services; and

 

               WHEREAS, Removing marijuana as a Schedule I controlled substance is in the interest of efficient use of Public Safety resources, the health and safety of our citizenry and marijuana business employees that may be exposed to increased violent crimes due to operating a high volume cash based business; and

 

               WHEREAS, The current system for classifying illegal drugs, the Federal Controlled Substances Act of 1970, is outdated and does not recognize the information presented on the beneficial uses of marijuana; and

 

               WHEREAS, The updated evidence from science and health professionals does not support continuing to classify Marijuana as a Schedule I drug.

 

               NOW, THEREFORE, BE IT RESOLVED that the City Council of Homer, Alaska, hereby requests that the United States Attorney General issue a final order to remove Marijuana from Schedule I of Controlled Substances under the Federal Controlled Substances Act of 1970.
