RESOLUTION 16-076
A RESOLUTION OF THE CITY COUNCIL OF HOMER, ALASKA, APPROVING A CONTRACT FOR GENERAL COUNSEL LEGAL SERVICES TO THE FIRM OF BIRCH HORTON BITTNER AND CHEROT IN THE MONTHLY AMOUNT OF $11,500.00 AND AUTHORIZING THE CITY MANAGER TO EXECUTE THE APPROPRIATE DOCUMENTS.
WHEREAS, The firm of Birch Horton Bittner and Cherot has provided legal services for the City of Homer for the past eight years; and
WHEREAS, Primary City Attorney Tom Klinkner has announced his retirement and will no longer be providing primary legal services to the City effective in August; and
WHEREAS, Attorney Holly C. Wells has been working with the City for years, is familiar with the City, and will be serving as primary City Attorney; and
WHEREAS, Resolution 16-049 authorized the City Manager to negotiate a new 3-year contract with Birch Horton Bittner and Cherot.
NOW, THEREFORE, BE IT RESOLVED that the Homer City Council finds that the firm of Birch Horton Bittner and Cherot is best suited to meet the legal needs and requirements of the City of Homer.
BE IT FURTHER RESOLVED that the City Council of Homer, Alaska, approves a 3-year contract with the firm of Birch Horton Bittner and Cherot of Anchorage, Alaska, in the monthly fixed fee amount of $11,500.00 with a biennial increase the lesser of the Anchorage Consumer Price Index or 5% and authorizes the City Manager to execute the appropriate documents.
PASSED AND ADOPTED by the Homer City Council this 27th day of June, 2016.
