SUBJ: EXEMPTION REQUEST FROM THE PRATT MUSEUM.
The Pratt Museum/Society of Natural History purchased the property in the Harrington Heights Water and Sewer District after the district was created.
Property Description: KPB Parcel Nos. 175-101-0700 and 175-101-1500, or Lots 1 and 9, A. Anderson Tract on Spruceview Avenue and Botts Street.
The Museum has maintained that they have an exemption. The City Attorney's legal opinion is attached and was given to the museum by fax at least once and
discussed more than once.
It is in the discretion of the City Council to grant them the requested exemption. This exemption would be handled the same as any other and the rest of the
property owners would not be penalized. The HAWSP would pay the exempted assessments.
RECOMMENDATION:
If Council agrees that the Museum should be exempted a simple amendment to the Resolution is required:
MOVE TO AMEND RESOLUTION 03-123, TO ADD ANOTHER BE IT FURTHER RESOLVED CLAUSE, TO READ: THE PRATT
MUSEUM/SOCIETY OF NATURAL HISTORY IS EXEMPT FROM WATER AND SEWER ASSESSMENTS IN THIS DISTRICT, FOR KPB PARCEL
NOS. 175-101-0700 AND 175-101-1500, THIS SHALL BE NOTED ON THE FINAL ASSESSMENT ROLL AND THE EXEMPTED ASSESSMENTS
SHALL BE PAID BY THE HOMER ACCELERATED WATER AND SEWER PROGRAM.
Fiscal Note: If approved would be funded via HAWSP, $7,844.08 each, for two parcels would be $15,688.16.
