SUBJ: LIQUOR LICENSE RENEWALS FOR KHARACTERS, HAPPY FACE, DOWN EAST SALOON, BAYSIDE LOUNGE, TRANSFER FOR BAYSIDE LOUNGE TO ALIBI AND APPLICATION OF WAIVER FOR OPERATING REQUIREMENT FOR THE RUM LOCKER

Notices from the ABC Board of the Liquor License Renewals and Transfer were received on October 27, 30, November 3, 10, and 13, 2003 for the following:

Renewals

Kharacters, Beverage Dispensary located at 197 E. Pioneer Avenue

Happy Face, Restaurant or Eating place Public Convenience located at 4400 Homer Spit Road

Down East Saloon, Beverage Dispensary located at 59909 East Road

Bayside Lounge, Beverage Dispensary located at 453 E. Pioneer Avenue

Transfer

Bayside Lounge to The Alibi, Beverage Dispensary located at 453 E. Pioneer Avenue

Memoranda from Chief of Police Robl state that the Homer Police Department has no objections to these liquor license renewals.

The Kenai Peninsula Borough has issued non objection to the all the renewals except Happy Face due to delinquent taxes, and non objection to the transfer.

Notice was received from Patel Enterprises, Inc. dba The Rum Locker for an Application for waiver of annual operation requirement for the Rum Locker. At this point this is informational.

RECOMMENDATION:

It is the recommendation of staff: That the City Council "voice non objection and approval"for the Liquor License Renewals for Kharacters, Down East Saloon, and the Bayside Lounge. That City Council "voice non objection and approval" for the Liquor License Transfer from Bayside Lounge to The Alibi. That the Council acknowledge the notice from the Rum Locker for application for a waiver. That the Council "voice non objection and approval" of the Happy Face License upon satisfaction of delinquent accounts with the Kenai Peninsula Borough.
