SUBJ: VACATE A PORTION OF A 20 FOOT ALLEY BETWEEN LOTS 90 AND 95, DEDICATED BY
OSCAR MUNSON SUBDIVISION (PLAT HM 3415); WITHIN SECTION 20, TOWNSHIP 6 SOUTH,
RANGE 13 WEST, SEWARD MERIDIAN, ALASKA; KPB FILE 2004-268; NOTE: PER PETITION, A 20
FOOT PEDESTRIAN AND UTILITY EASEMENT TO BE GRANTED; PETITIONERS: ROBERT J. AND
PAMELA J. BRANT OF HOMER, ALASKA.
Notice of the vacation was received via fax on November 24, 2004.
In accordance with AS 29.40.140, no vacation of a City right-of-way and/or easement may be made without the
consent of the City Council.
The Kenai Peninsula Borough Planning Commission approved the proposed vacation during their regularly
scheduled meeting of November 22, 2004.
The City Council has thirty days from November 22, 2004 in which to veto the decision of the Kenai Peninsula
Planning Commission.
The Homer Planning Commission has no objection to granting this vacation upon the dedication of a twenty foot
Pedestrian/Utility Easement.
RECOMMENDATION:
Voice non objection and consent to the Vacate a portion of a 20 foot Alley Between Lots 90 and 95, Dedicated
by Oscar Munson Subdivision (Plat HM 3415); within Section 20, Township 6 South, Range 13 West, Seward
Meridian, Alaska; KPB File 2004-268; Note: Per petition, a 20 foot Pedestrian and Utility Easement to be
granted; Petitioners: Robert J. and Pamela J. Brant of Homer, Alaska
