SUBJ: Councilmember Ladd's Notice of Reconsideration regarding Resolution 04-42, Of the City Council Determining, Pursuant to Homer City
Code 17.04.030(d), that the East End Road Water and Sewer Improvements are Needed and Authorizing the City Clerk to Proceed with the
Petitioning Process for said Improvements.
Councilmember Ladd issued notice of reconsideration on Tuesday, April 27, 2004 at 8:39 p.m. and this was received in the Clerk's Office on
Wednesday, April 28, 2004 at 7:40 a.m.. This reconsideration notice complies with Council's Bylaws wherein notice of reconsideration must occur
within forty eight hours of Council's action by a Councilmember voting on the prevailing side. Councilmember Ladd did vote on the prevailing side.
The vote was non objection, unanimous consent and four Councilmembers were present.
If reconsideration passes, Resolution 04-42, main motion is back on the floor under Resolutions.
Councilmember Ladd has relayed a concern regarding the water extension portion of this Resolution, including, but not limited to, extending water
along East End Road in the Kachemak City vicinity and to non City of Homer residents.
The motion to reconsider must be made by one who voted on the prevailing side: Councilmember Beck, Ladd, Novak or Stark. This motion may be
seconded by any Councilmember.
RECOMMENDATION:
Move for reconsideration of the vote on Resolution 04-42 having voted in favor for the Resolution.
