SUBJECT: Amendment to 21.59 Bridge Creek Watershed Protection District
In reviewing the proposed amendment to HCC 21.59, Bridge Creek Watershed Protection District it became apparent that it is unclear as to whether all driveways would be allowed to be calculated as having reduced impervious coverage with an approved mitigation plan for all areas in the District or for only those lots eligible to submit a mitigation plan (lots under 2.5 acres). Staff requested clarification from the Homer Advisory Planning Commission on June 1, 2005 as to what the intent of the Commission is. The Commission indicated their intent is that only lots eligible to submit a mitigation plan should be eligible for having driveways calculated as less than 100% impervious. As a result staff recommends the following amendment. The proposed amendment has been forwarded to the City Attorney for review.
Recommendation:
HCC 21.59.070(b)(1)
amended as follows (found beginning at line 49)
1. Except as
provided in subparagraph 2., the minimum area of any parcel shall be 4.5
acres. For the purpose of calculating impervious
coverage, driveways and walkways may be partially or fully excluded from the
calculation if constructed and maintained in accordance with a mitigation plan,
submitted in accordance with HCC 21.59.070(a)(2).
