SUBJECT: An Ordinance Of The City Council Amending The Homer City Zoning Map, HCC 21.36, Rezoning From Central Business District And Marine Industrial District To Conservation District, Certain Properties Already Encumbered By Conservation Easements.
The
City of Homer in conjunction with the
Exxon Valdez Oil Spill Council and the Kachemak Heritage Land Trust has
acquired certain properties on the Homer Spit and in Beluga Slough. These properties have very strict
conservation easements attached to their deeds restricting their
development.
In
preparation for acceptance of the Exxon
Valdez Oil Spill Council’s selected properties, the City of Homer
enacted Homer
City Code 21.58 Conservation District in December of 1999.
Presently there are no properties within the
Conservation District zone. It was the
intent that all properties with conservation easements would be placed
in this
district.
This
proposed ordinance includes all property
the City received through the EVOS process plus Louie’s Lagoon which
also has a
conservation easement.
The
Homer Advisory Planning Commission held a
public hearing on the proposed amendment on December 1, 2004.
Recommendation
The
Homer Advisory Planning Commission
recommends the Homer City Council adopt the ordinance and amend the
Zoning Map.
