SUBJ: ORDINANCE 05-65

Requesting that HCC 17.04.030(a) be reworded so that the owner or owners of at least 50% of properties in an area my request an Improvement District.

Justification: HCC 17.04.030(s) states that at least 50% of property owners must sign the form requesting an improvement district. This implies that if there are three property owners in the area, and one owner owns ten lots, and the other two property owners own one lot each, that these two property owners could keep the application from being filed.

RECOMMENDATION:

Introduce Ordinance 05-65 and send it to public hearing.
