SUBJECT: Additional Recommendation from the Homer Advisory Planning Commission on Ordinance 05-17 Amending Homer City Code Chapter 21.68 and Enacting Section 21.30.030 to Authorize Setting Fees by Resolution.
In addition to the previously submitted
comments on the above referenced ordinance the Homer Advisory Planning
Commission makes the following comments:
While present staff and administration has
shown a commitment to zoning enforcement some future administration may not be
sympathetic. The present draft
ordinance completely does away with the rights of the public to compel zoning
enforcement other than through the court system. While the present code does not have a system in place to
accomplish this, to completely remove this ability does not seem to be in the
public’s best interest.
In addition, the Commission re-emphasizes
their previous recommendation that the definition of “person aggrieved” be
broadened to not only allow property owners the right to appeal.
Recommendation:
The Homer Advisory Planning Commission recommends adoption of the amendment HCC 21.68 Appeals with amendments.
