SUBJECT: Recommendation for a change to the Fee Schedule
The Homer Advisory Planning Commission at the regular meeting of February 16, 2005 discussed the fee schedule as it relates to zoning permits. Staff has informed the Commission that often construction begins before a zoning permit has been obtained. Homer City Code states the following: HCC 21.42, Zoning Permit. HCC 21.42.010 (b) states: The zoning permit required by this section shall be obtained prior to the commencement of any excavation, construction, or other aspect of the work for which the permit is required.
This fee schedule amendment provides a financial disincentive for commencing without a permit an activity that requires one. Instead of being fined or otherwise sanctioned, an applicant may simply apply for a permit by paying the increased fee. Revenue from increased fees should be used to offset costs incurred by the Planning Department in conducting zoning compliance activities.
Recommendation
The Homer Advisory Planning Commission recommends the Homer City Council amend the City of Homer fee schedule as follows:
Fees for activities regulated by HCC 21.42.010 (a)
that have
commenced without a permit required
by HCC 21.42.010 (b) shall be assessed at the
regular
rate multiplied by the percentage rates
indicated in the following chart:

Use Permit |
Payment of an increased application fee shall have the same effect as payment of the regular fee and will not guarantee that a permit will be issued. All applications for zoning or conditional use permits must be processed in accordance with Homer City Code Title 21, Zoning and Planning.
