SUBJ: COUNCILMEMBER HEMIBUCH'S NOTICE OF INTENT TO RECONSIDER RESOLUTION 05-45.

Councilmember Heimbuch issued Notice of Intent to Reconsider Resolution 05-45, on Tuesday, April 26, 2005 at 8:45 a.m., in person. Councilmember Heimbuch voted on the prevailing side, the vote failing with a 2/4 vote.

April 25, 2005 - Resolution Title, Sponsor, Motion and Vote.

Resolution 05-45, Of the Homer City Council Requesting a Right of Way Use Agreement with the Alaska Department of Transportation and Public Facilities (ADOT &PF) for Additional Spit Trail Parking at the Base of the Spit. Novak.

Main Motion: WYTHE/NOVAK - MOVED FOR THE ACCEPTANCE OF RESOLUTION 05-45 BY READING OF TITLE.

VOTE: YES: NOVAK, YOURKOWSKI.

NO: STARK, HEIMBUCH, McLAY, WYTHE.

Motion failed.

If reconsideration is approved, Resolution 05-45 is back on the floor under Resolutions.

RECOMMENDATION:

Recommend approving reconsideration.
