SUBJ: REQUEST FOR EXECUTIVE SESSION AS 44.62.310(C)(1), MATTERS, THE IMMEDIATE
KNOWLEDGE OF WHICH WOULD CLEARLY HAVE AN ADVERSE EFFECT UPON THE FINANCES
OF THE GOVERNMENT UNIT AND ATTORNEY-CLIENT PRIVILEGE. (HOSPITAL LAND
NEGOTIATIONS AND OCEAN DRIVE LOOP BLUFF EROSION CONTROL - LITIGATION MATTERS.)
The Mayor, City Council and the City Manager agreed to conduct an Executive Session with the City Attorney
regarding South Peninsula Hospital Lease with the City and City Property Ownership issues and concerns. The
Executive Session was scheduled for Tuesday, May 24th during a Special Meeting to be held between the
Committee of the Whole and the Regular Meeting. The Executive Session requested precipitated as a result of the
worksession that was held on Tuesday, May 10th at 10 a.m. with Borough Mayor Bagley and Assemblymembers
Martin and Moss. Others present were South Peninsula Hospital Executive Director Franz, South Peninsula
Hospital Service Area and Operating Board members, Dr. Paul Eneboe, and South Peninsula Hospital Expansion
Project Manager Wayne Aderhold, general public, news media, etcetera.
City Manager Wrede requested that the Ocean Drive Loop Bluff Erosion Control - Litigation Matters be included
with this executive session.
RECOMMENDATION:
Approve request for Executive Session and conduct immediately in the Conference Room.
Fiscal Note: Budgeted. City Attorney costs.
