SUBJ: RECONSIDERATION OF RESOLUTION 06-81.

Councilmember Shadle gave Notice of Reconsideration on Resolution 06-81 on Tuesday, June 27, 2006 at approximately 1:41 p.m., well within the 48 hour period for reconsideration the action having been taken on Resolution 06-81 on Monday, June 26, 2006 during the Regular Meeting under Resolutions.

Pursuant to Council Bylaws: HCC 1.24.040(i.) Motions to reconsider: A member of the Council who voted with the prevailing side on any issue may move to reconsider the Council's action at the same meeting or at the next regular meeting of the body. Notice of Reconsideration shall be given to the Mayor or City Clerk within forty-eight hours from the time the original action was taken.

McLAY/SHADLE - SO MOVED FOR THE ADOPTION OF RESOLUTION 06-81 BY READING OF TITLE ONLY.

There was discussion. There was a motion to postpone that failed.

VOTE: (main motion) YES: NOVAK, McLAY, WYTHE.

NO: SHADLE, STARK.

Motion failed.

After Councilmember Shadle issued his Notice of Reconsideration, Councilmember Stark also gave Notice of Reconsideration.

If reconsideration is approved, the main motion on Resolution 06-81 is back on the floor under Resolutions.

RECOMMENDATION:

Approve reconsideration.
