SUBJ: VACATION OF A 50 FOOT RADIUS HALF CUL-DE-SAC TEMPORARY TURN AROUND,
GRANTED WITHIN LOT 6 BLUFF PARK NO 4. (HM 85-120); CARRIED FORWARD WITHIN LOT 9,
BLUFF PARK NO. 4 HARMON-PORTER ADDITION (PLAT HM 97-5), WITHIN SECTION 19, TOWNSHIP 6
SOUTH, RANGE 13 WEST, SEWARD MERIDIAN, HOMER, ALASKA. PAUL R. AND BETTY JO PORTER
OF BEAVER, UTAH.
Notice of the vacation was received via fax on September 14, 2006. City Manager Wrede and City Planner McKibben were emailed regarding this vacation. Planning Clerk Rosencrans provided a letter from the City Planner dated August 18, 2006 to Mary Toll, Borough Platting Officer, that states that the City of Homer does not object to this vacation.
In accordance with AS 29.40.140, no vacation of a City right-of-way and/or easement may be made without the
consent of the City Council.
The Kenai Peninsula Borough Planning Commission approved the proposed vacation, as petitioned, during their
regularly scheduled meeting held on September 11, 2006.
The City Council has thirty days from September 11, 2006 in which to veto the decision of the Kenai Peninsula
Planning Commission. The City of Homer has no objection to granting this vacation as petitioned. It is noted that this
was cited as a temporary easement in the associated plats and that it was to be automatically vacated upon extension
of Waddell Street.
RECOMMENDATION:
Voice non veto to Vacation of a 50 Foot Radius Half cul-de-sac Temporary Turn Around, Granted within Lot 6
Bluff Park No 4. (HM 85-120); Carried Forward within Lot 9, Bluff Park No. 4 Harmon-Porter Addition (Plat HM
97-5), within Section 19, Township 6 South, Range 13 West, Seward Meridian, Homer, Alaska. Paul R. and Betty
Jo Porter of Beaver, Utah.
