Subject: Tulin Terrace Subdivision - West Terrace Unit #1 and #2

City Acceptance of Roads for Rural Road Maintenance

The Tulin Terrace Subdivision was created prior to annexation. The attached map shows the location of this property. The subdivision consists of 49 lots with approximately 4800 lf of road. At the time of annexation, the roads within the subdivision were not maintained by the Borough and were not identified as roads that the City should maintain. Since that time, the owner of the subdivision has made improvements to the roads. This work was completed in anticipation of requesting City maintenance of the roads to a rural residential standard. The work generally conforms to the requirements for rural road maintenance, but a few items still need to be resolved (see below).

Public Works inspection personnel worked with the owner and his contractor this last summer to identify what improvements needed to be completed. The City Council has approved a list of conditions that must be met before accepting new roads into the rural residential maintenance program. Based on the work that was completed and the documentation provided, Public Works is prepared to recommend that the City accept the improvements for City maintenance under the following conditions:

1. City maintenance would not start until there are people living in the subdivision. (One of the conditions that must be met to receive rural road maintenance is there must be one residence for every 300 lineal feet of road maintained. This would suggest that at least 12 homes might have to be built before the City would begin to maintain all roads within the subdivision. I would expect that the City would extend maintenance in stages, based on where the first residents live.)

2. Maintenance provided would be to the Rural Road standards.

3. The cul-de-sac's (Whisper, Meadow, Tulin Bluff West, and Tulin Bluff East Courts) be enlarged ( 80 diameter) and be contained within the dedicated street right-of-way and provide adequate maneuvering room for emergency vehicles as directed by the Public Works Director.

4. Drainage easements shall be executed across several lots to accommodate drainage ditches that currently direct surface water from the roads on to and across adjacent lots as directed. (Some of these situations could be resolved by relocating drainage ditches into street right-of-way.)

5. Make minor modifications to the submitted plan and profile drawings to document the above work and add minor items (such as road grades in percent, etc.) as directed by Pubic Works.

6. For a period of two years after acceptance of the roads by the City Council and completion of the work described above), the subdivision owner shall be responsible for repairing any portion of the road that does not support vehicular traffic.

Recommendation: The City Council accept these roads for maintenance under the conditions stated above and authorize adding these roads to the City's Official Road Maintenance map.
