SUBJ: COUNCILMEMBER SHADLE NOTICE OF RECONSIDER OF ORDINANCE 06-51(S)(A).

Councilmember Shadle issued Notice of Reconsider of Ordinance 06-51(S)(A), on Wednesday, September 27, 20065 at approximately 2:57 p.m., via telephone. Councilmember Shadle voted on the prevailing side, the vote passing - non objection, unanimous consent. This action took place during the Regular Council Meeting of June September 25, 2006.

Pursuant to Council Bylaws: HCC 1.24.040(i.) Motions to reconsider: A member of the Council who voted with the prevailing side on any issue may move to reconsider the Council's action at the same meeting or at the next regular meeting of the body. Notice of reconsideration shall be given to the Mayor or City Clerk within forty-eight hours from the time the original action was taken.

The October 9th Regular Meeting is the next Regular Meeting of the City Council.

Ordinance 06-51(S)(A), Of the City Council of the City of Homer, Alaska Amending Homer City Code Title 21 (Zoning) to Create a new Gateway Business District known as Chapter 21.55 and Amending the Zoning Map to Rezone Portions of Rural Residential (RR) and Portions of Urban Residential (UR) Zoning Districts Fronting on the Sterling Highway West Hill Area to the South West Boundary of the Central Business District (CBD). City Manager. Planning. (First Reading August 28, 2006, Public Hearing September 11, 2006, Second Reading September 25, 2006.)

There were several amendments that were disposed of and the vote on the main amended motion was non objection, unanimous consent.

If reconsideration is approved, the main motion, as amended, on Ordinance 06-51(S)(A) is back on the floor under Ordinances.

RECOMMENDATION:

Recommend voting on reconsideration.
