SUBJ: REQUEST TO CONDUCT SPECIAL MEETING ON OCTOBER 23, 2006 AT 5:30 P.M. REGARDING ALLEGED ETHICS VIOLATION AGAINST COUNCILMEMBER DOUG STARK.

Mayor Hornaday has recused himself from this matter, Doug Stark having been a client and the Mayor having served as legal counsel for Doug Stark.

Mayor Pro Tempore McLay, exercising his authority as Mayor Pro Tempore in the Mayor's absence with regard to this issue, called for this matter to be added to the Council's Agenda pursuant to the provision in Council's Operating Manual and at the request of Councilmember Wythe.

This matter will not be discussed at this meeting. A special meeting will be scheduled to hear the matter.

RECOMMENDATION:

Approve the conduct of a Special Meeting on October 23, 2006 at 5:30 p.m., between the Committee of the Whole and the Regular meeting regarding the alleged ethics violation against Councilmember Doug Stark.
