SUBJ: REQUEST FOR EXECUTIVE SESSION PURSUANT TO AS § 44.62.310(C)(1), MATTERS, THE IMMEDIATE KNOWLEDGE OF WHICH WOULD CLEARLY HAVE AN ADVERSE EFFECT UPON THE FINANCES OF THE GOVERNMENT UNIT AND ATTORNEY CLIENT PRIVILEGE. (FULLER VS. CITY - SETTLEMENT OFFER AND CITY WATER WITHOUT CITY SEWER AND ASSOCIATED ISSUES AND MATTERS WITH REGARD TO SEWER LINE EXTENSIONS. )

Pursuant to Council's Operating Manual - "Any Councilmember, the Mayor or City Manager may place consideration of an executive session on the agenda...."

The City Manager requests an Executive Session Regarding the Fuller versus City Case to discuss the Settlement Offer. The deadline on the offer is October 25, 2006.

Councilmember Shadle requested an Executive Session Regarding supplying City Water without City Sewer.

Councilmember Heimbuch has some attorney client privilege questions with regard to Sewer Line Extensions.

RECOMMENDATION:

Approve the above request for Executive Session, authorize attendance by pertinent staff, and conduct immediately in the Conference Room.
