SUBJECT: Proposed Amendment to HCC 21.21.52 Marine Commercial District
The Planning Commission began discussing proposed amendments to both the Marine Commercial and the Marine Industrial Districts in June 2006. The Commission initiated several amendments and subsequently staff added several more. The proposed amendments were sent to the Port and Harbor Commission for input. The Commission considered their comments and made further revisions. At this time the Commission decided to continue only working on amendments to the Marine Commercial District and moved amendments to the Marine Industrial District to their work list.
A draft of the Marine Commercial
district amendments was provided to the City Attorney for review.
A public hearing was held on the draft ordinance on October 26, 2006. Written comments are included with this
memorandum. One person testified at the
hearing in support of the proposed amendments.
The Commission then considered the suggested changes by the City Attorney, amended the ordinance and voted to forward it to the City Council for consideration.
Comprehensive Plan
The 1999 Comprehensive Plan update goal for the Homer Spit Plan is “manage the land and other resources of the spit to accommodate its natural processes, while allowing fishing, tourism, other marine related development, and open space/recreational uses.”
The plan further states objectives which include:
· Provide for public safety while achieving a balanced mix of water-dependent and marine-related activities on the Homer Spit.
· Priority for use of the Small Boat Harbor and distal end of the Homer Spit shall be given to marine commercial, marine industrial (fishing), industrial transportation, tourism, and day use recreation.
· Promote a low impact use concept for the west side of the Spit in the update of the zoning code.
The 1989 Comprehensive Plan includes a summary of a 1987 Survey of Development Options for the Homer Spit. One interesting finding of this report is that “The vast majority of Homer residents do not want to separate the different land uses on the spit.”
One of the objectives of the 1989 plan is “Maintain the mix of land uses on the Spit.” One of the policies for this objective is “The City shall adopt a Marine Business zoning district which combines existing commercial and industrial land uses into one “Marine Business” zoning designation.

Recommendation:
The Homer Advisory Planning Commission
recommends the Homer City Council adopt the ordinance as proposed.
