SUBJECT:       Ordinance 06-12, Of the City Council of the City of Homer, Alaska Amending Homer City Code 21.48, Central Business District (CBD) by Deleting Some Allowed Uses.

 

At the regular meeting held on April 5, 2006 the Homer Advisory Planning Commission held a public hearing to take comments on the above referenced Ordinance.  The Commission discussed this item. They did not accept the staff report (attached).  The staff report recommends removing additional permitted and conditional uses and structures should the Central Business District be expanded.  The Commission was in support of this concept.  However, they are concerned with the timing of the proposal.  It is awkward to remove uses and structures from an area that has not yet been rezoned.  Additionally, the schedule for the proposed ordinance amendment has not allowed staff or the commission to perform a thoughtful and complete evaluation of uses and structures that are appropriate for the area.   Furthermore, the proposed amendment seems to be out of sequence with the Gateway planning process that the Council directed staff and the Commission to undertake.   The Commission notes that staff has indicated this timing of that Gateway planning process, this ordinance amendment, and the proposed expansion of the Central Business District has proven to be very confusing to the public.

 

Recommendation

 

The Homer Advisory Planning Commission recommends the Council not adopt the ordinance.
