SUBJ: REQUEST FOR EXECUTIVE SESSION AS § 44.62.310(C)(1), MATTERS, THE IMMEDIATE KNOWLEDGE OF WHICH WOULD CLEARLY HAVE AN ADVERSE EFFECT UPON THE FINANCES OF THE GOVERNMENT UNIT AND ATTORNEY CLIENT PRIVILEGE REGARDING THE LATER ITEM. (UA NEGOTIATIONS AND NEW CITY HALL AND POSSIBLY ON THE OCEAN DRIVE LOOP BLUFF EROSION CONTROL ASSESSMENT DISTRICT PROJECT (SEAWALL).)

Pursuant to Council's Operating Manual - "Any Councilmember, the Mayor or City Manager may place consideration of an executive session on the agenda...."

The City Council held a discussion about planning for a new City Hall during the Committee of the Whole Meeting on May 22, 2006.

The Mayor and City Manager discussed the need for an Executive Session since there are pending negotiations about the current City Hall such as possible purchase, etc, with the University. An Executive Session was scheduled to provide for the Council to discuss, in closed session and possibly with the City Attorney, the pending negotiations with the University regarding their potential acquisition of the current City Hall.

The City Manager requested inclusion of the Ocean Drive Loop Bluff Erosion Control Assessment District Project for the Executive Session since there are some pending matters regarding the settlement of that project that the City Attorney may need to update the Council about and there may need to be some discussion regarding associated elements of that matter.

RECOMMENDATION:

Approve the above request for Executive Session, authorize attendance by pertinent staff, and conduct immediately in the Conference Room.
