RE:                  Follow-up Discussion – Non-Conforming “Spaghetti” Service Ordinance

The City Council is contemplating an ordinance that deals with how property owners served by non-conforming “spaghetti” lines will reconnect to the water system when a main is  available adjacent to the property.  Ordinance #09-45 was passed on its first reading; but final action has been postponed until those affected can comment and staff can review.

 

Public Works promised to review the ordinance and make comments.  These comments were forwarded to the City Attorney and were incorporated into the supplemental ordinance present in the current Council packet.  Public Works comments consisted generally as follows:

 

1.      All water or sewer service connections to the City of Homer’s water distribution or sewer collection systems that are not made on a mainline that is directly adjacent to the property being served shall be reconnected to a mainline that is subsequently installed adjacent to the property being served within one year of the mainline becoming available for service.

2.      Those services that require immediate connection during construction of the mainline in order to maintain service to the property will be required to make immediate connection during the mainline construction project.

3.      All costs associated with reconnecting the service to the new service stubout will be borne by the property owner of the property being served.

4.      The property owner will pay their share of the costs for extending the mainline through whatever method is approved by the City of Homer for the specific project.  The extension could be through a Local Improvement District, private development, public project, or other approved methods.

5.      The conditions under which the property owner reimburses  the City of Homer or Developer will be made known prior to any work being accomplished.

 

The Council requested that Public Works contact all of the property owners that maybe affected by the proposed ordinance so that they can comment on the proposed ordinance. Attached is a list of the 52 property owners and the letter that was sent to them.

 

 

 

List of Non-Conforming Water and Sewer Services

 

 

Following is a list of known, existing spaghetti lines.  For the purposes of this memo, and as defined by Resolution 04-55, and HCC 13.24.040 f, and 13.28.030, spaghetti line (or a non-conforming service) is one that serves a property where no mainline is directly adjacent to it.  The term, “adjacent to it” is defined as having a main adjacent to the entire frontage of the property.

 

Some of these properties may not be viewed as having a traditional spaghetti line because their connection to the main may extend directly perpendicular to the property since the main may front a small portion of the property.  But, as technically defined, the services are non-conforming, or spaghetti lines.
