Session 06-01, a Special Meeting of the Homer City Council was called to order at 11:01 a.m. by
Mayor James C. Hornaday at the Homer City Hall Cowles Council Chambers located at 491 E
Pioneer Avenue, Homer, Alaska, and opened with the Pledge of Allegiance.

The agenda was approved by consensus of the City Council.

NEW BUSINESS
A. Memorandum 06-01, from City Clerk, Re: Request for Executive Session AS §
44.62.310(C)(1), Matters, the Immediate Knowledge of which would Clearly have an Adverse
Effect upon the Finances of the Government Unit and Attorney-Client Privilege. (Hurlen
Settlement Offer- Pioneer Dock Project.)
RECOMMENDATION: Approve the above request for Executive Session and conduct
immediately in the Conference Room.
McLAY/NOVAK - MOVED TO GO INTO EXECUTIVE SESSION TO DEAL WITH THE
HURLEN ISSUE AT THIS POINT AND THAT PUBLIC WORKS DIRECTOR IS INVITED.
There was no discussion.
VOTE: YES: NON OBJECTION. UNANIMOUS CONSENT.
Motion carried.
Mayor Hornaday recessed the Special Meeting to Executive Session at 11:03 a.m. and reconvened
the Special Meeting at 11:45 a.m.
Mayor Pro Tempore McLay stated that the Council teleconference with their Attorneys,
Councilmember Shadle participated telephonically as did the City Manager. He advisee that the
Council discussed the counter offer made and after discussion with the Public Works Director and
the Attorneys the Council made recommendation to their attorneys and will wait to hear from them
to see what comes from Council's recommendation.

City Attorneys Kreger and Leik participated telephonically during the Executive Session.

ADJOURNMENT
There being no further business to come before the Council, Mayor Hornaday adjourned the
meeting at 11: 46 a.m. The Next Regular Meeting is scheduled for Monday, January 9, 2006 at 7
p.m. and the next Committee of the Whole is scheduled for Monday, January 9, 2006 at 4 p.m.
