Session 04-01, a Special Meeting of the Homer City Council was called to order at 5:31 p.m. by Mayor Jack Cushing at the Homer City Hall Council Chambers located at 491 E Pioneer Avenue, Homer, Alaska, and opened with the Pledge of Allegiance.

The Committee of the Whole meeting was held from 4:08 to 5:30 p.m. regarding the Regular Meeting Agenda, Bill Popp KPB Oil and Gas Liaison - update on Oil and Gas Matters, Kenai Peninsula Borough, and Kenai Peninsula Borough Comprehensive Plan.

A. Memorandum 04-01, from City Clerk, Re: Request for Executive Session Pursuant to AS'44.62.310(c)(1), Matters, the Immediate Knowledge of Which Would Clearly Have an Adverse Effect Upon the Finances of the Government Unit. Ocean Drive Loop Bluff Erosion Control (Seawall) Project and Gates Spit Lease. Conduct Executive Session immediately upon approval, teleconference with City Attorney as needed.

Recommendation: Approve the request for Executive Session and conduct immediately.

FENSKE/BECK - MOVED FOR THE APPROVAL OF THE RECOMMENDATION OF MEMORANDUM 04-01.

There was no discussion.

VOTE: NON OBJECTION. UNANIMOUS CONSENT.

Mayor Cushing recessed the Special meeting to Executive Session at 5:33 p.m. reconvening the Special meeting at 7:01 p.m.

Statement: Council reviewed the two issues, one being the Ocean Drive Loop Bluff Erosion Control Assessment District. Directions were given to the Attorney and no further action was taken. Second issue we dealt with were the Gates' Leases. We received a report on the Gates Lease and potential financial ramifications and termination of those leases. No action was taken.

Mayor clarified that it was ramifications of terminations and Ocean Drive Loop Bluff Erosion Control Seawall Project.
