Session 05-02, a Special Meeting of the Homer City Council was called to order at 7 p.m. by Mayor Pro Tempore Michael Yourkowski at the Homer City Hall Council Chambers located at 491 E Pioneer Avenue, Homer, Alaska, and opened with the Pledge of Allegiance.

PRESENT: COUNCILMEMBERS: BECK, McLAY, NOVAK, STARK, WYTHE, YOURKOWSKI.

ABSENT: MAYOR: HORNADAY (excused)

The Council met as a Committee of the Whole from 4:05 to 5:30 p.m. and discussed the LID Process and regular agenda items.

AGENDA APPROVAL

(Addition of items to or removing items from the agenda will be by unanimous consent of the Council. HCC 1.24.040.)

The agenda was approved by consensus of the City Council.

PUBLIC COMMENTS UPON MATTERS ALREADY ON THE AGENDA

There were no public comments.

NEW BUSINESS

A. Memorandum 05-10, from City Clerk, Re: Request for Executive Session Pursuant to AS 44.62.310(C)(2), Subjects that tend to prejudice the reputation and character of any person, provided the person may request a public discussion; AS 44.62.310(C)(1), Matters, the Immediate Knowledge of which would Clearly have an Adverse Effect upon the Finances of the Government Unit; and for Attorney - Client Privilege. (Hamilton Settlement). City Attorney on Personnel Matters, Tom Daniels, participated telephonically.

Mayor Pro Tempore Yourkowski read the Request for Executive Session into the record.

Recommendation: Recommend approval and conduct immediately.

NOVAK/WYTHE - MOVED TO PLACE THIS ON THE FLOOR.

Councilmember Beck respectfully asked to be excused from participating, advising that she has a professional conflict of interest.

Mayor Pro Tempore Yourkowski concurred and there were no objections from the Council.

City Manager Wrede advised that the Personnel Officer, Sheri Hobbs, and Chief of Police, Mark Robl, who are both intimately involved in this matter are standing by if the Council would like their participation.

Mayor Pro Tempore Yourkowski called for a consensus of the Council for the Personnel Officer and Chief of Police to participate.

There was a consensus of the Council.

VOTE:(Request for Executive Session) YES: NON OBJECTION. UNANIMOUS CONSENT.

Motion carried.

Mayor Pro Tempore Yourkowski recessed the Executive Session at 5:35 p.m. reconvening the meeting at 7:03 p.m.

Mayor Pro Tempore Yourkowski stated that the Council met with their Attorney and gave him instructions on the personnel matter.

City Attorney Daniels participated telephonically during Executive Session.

ADJOURNMENT

There being no further business to come before the Council the meeting was adjourned at 7:04 p.m. The January 24th Regular Meeting began directly following adjournment. The next regular Meeting is scheduled for February 14, 2005 at 7 p.m. and the next Committee of the Whole is scheduled for Monday, February 14, 2005 at 4 p.m. A special meeting has been scheduled for Monday, February 7, 2005 at 7 p.m. for a Board of Adjustment Appeal Hearing regarding the Vann Appeal. All meetings scheduled to be held in the Homer City Hall Council Chambers located at 491 E. Pioneer Avenue, Homer, Alaska.
