Session 05-19, a Special Meeting of the Homer City Council was called to order at 5:35 p.m. by Mayor James C. Hornaday at the Homer City Hall Council Chambers located at 491 E Pioneer Avenue, Homer, Alaska, and opened with the Pledge of Allegiance.

PRESENT: COUNCILMEMBERS: McLAY, NOVAK, STARK, WYTHE, YOURKOWSKI.

STAFF: CITY ATTORNEY TANS (Telephonically during Executive Session.)

Council met as a Committee of the Whole from 4:02 p.m. to 5:29 p.m. regarding the Regular Meeting Agenda items and specifically the State and Federal Capital Budget Requests and Junk Vehicles, also discussed were the Budget Priorities for 2006 and intersections.

AGENDA APPROVAL

(Addition of items to or removing items from the agenda will be by unanimous consent of the Council. HCC 1.24.040.)

The agenda was approved by consensus of the City Council.

PUBLIC COMMENTS UPON MATTERS ALREADY ON THE AGENDA

Public Comments on Memorandum 05-120 only.

There was no public present.

NEW BUSINESS

A. Memorandum 05-120, from City Clerk, Re: Request for Executive Session AS 44.62.310(C)(1), Matters, the Immediate Knowledge of Which Would Clearly Have an Adverse Effect Upon the Finances of the Government Unit and Attorney-Client Privilege. (Hospital Land Negotiations.) If approved, conduct immediately.

Recommendation: Approve request for Executive Session and conduct immediately in the Conference Room.

McLAY/WYTHE - MOVED FOR THE APPROVAL OF THE RECOMMENDATION OF MEMORANDUM 05-120.

There was no discussion.

VOTE: YES: McLAY, WYTHE, YOURKOWSKI, STARK, NOVAK.

ABSENT: HEIMBUCH.

Motion carried.

Mayor Hornaday recessed the Special Meeting to Executive Session at 5:37 p.m. and reconvened the Special Meeting at 6:07 p.m.

Councilmember Yourkowski stated that the Council met with the City Manager and City Attorney regarding the Hospital Land Issues, no actions were taken and that instructions were given to the City Manager regarding the Hospital Issues.

There being no further business to come before the Council, Mayor Hornaday adjourned the meeting at 6:08 p.m. The Regular Meeting follows at 7 p.m. The next Regular Meeting is scheduled for Monday, August 8, 2005 at 7 p.m. and the next Committee of the Whole is scheduled for Monday, August 8, 2005 at 4 p.m. A Special Meeting is scheduled for Monday, August 8, 2005 at 5:30 p.m. for the Homer City Council to sit as the Board of Adjustment to conduct an Appeal Hearing on the Appeals to the Board of Adjustment Regarding Conditional Use Permits 05-09 and 05-10. All meetings scheduled to be held in the Homer City Hall Council Chambers located at 491 E. Pioneer Avenue, Homer, Alaska.
