Session 00-22, a Regular Meeting of the Homer City Council was called to order at 7:32 p.m. by Mayor Cushing at the Homer City Hall Council Chambers located at 491 E. Pioneer Avenue, Homer, Alaska, and opened with the Pledge of Allegiance.

A worksession was held from 6:32 to 7:17 p.m. Re: 90% Design Completion of the Small Boat Harbor Repairs and Renovation Project, presentation by John Pickering of Peratrovich, Nottingham and Drage.

FENSKE/KRANICH - MOVED FOR UNANIMOUS CONSENT OF CONTINUATION OF OUR CURRENT MAYOR PRO TEM.

Council voiced unanimous consent and confidence in Councilmember Marquardt and that he remain as Mayor Pro Tem for 2000/2001.

RESOLUTIONS

A. Resolution 00-103, Of the City Council of the City of Homer, Alaska, Authorizing the Formation of the Jenny Way Road Reconstruction Improvement/Assessment District and Authorizing the City Manager to Proceed with the Preparation and Construction of said District. City Clerk. HARP project.

FENSKE/MARQUARDT - MOVED FOR ADOPTION OF RESOLUTION 00-103 BY READING OF TITLE.

Council commented on the joy that the residents of Jenny Way feel about seeing this project come to fruition. It was noted that this road has been in need of a fix for a long time and it is good for it to be moved up on the list of road projects. There are some serious safety issues associated with this road, which is one of the top criteria in the HARP.

In response to Council query, Public Works Director Meyer advised that some right-of-way may need to be acquired, due to the current inadequate width of the road, for the improvements.

Mayor Cushing suggested getting easements without having to purchase property.

Public Works Director Meyer stated that if it is possible to acquire "public use easements" instead of right-of-ways, this easement would need to allow for the construction and maintenance and any improvements that would be used by the public. He pointed out that this is not normally done, except in a true easement fashion, but that it is an option that Public Works will take a look at, see if the property owners are willing and if it makes sense economically.

Regarding Woodard Creek protection concerns, the Public Works Director stated that he is not completely familiar with the project site, however, has the impression that there already is a culvert in Woodard Creek under Jenny Way. He suggested that this project be designed to not impact Woodard Creek any more than it has been right now. He further suggested that the best thing to protect the creek is to do a design and construct without developing erosion problems and to seed the area of concern with grass seed. Getting the grass growing will assist in preventing sediment from washing into Woodard Creek.

Councilmember Cue specifically asked that if at all possible this protection of Woodard Creek be done as a part of the design and construction phase of the Jenny Way road development.

City Manager Drathman announced that his son, Max, has a birthday on November 6th and that his daughter is still driving.

COMMENTS OF THE MAYOR

Mayor Cushing commented on the Planning Commission's meeting tomorrow night and that there are a lot of important matters on the Commission's agenda. He noted that some of these matters will be forwarded to the Council. The Mayor suggested that Councilmembers attend the meeting or at least contact one or more Planning Commissioners regarding the meeting plus reading the Commission minutes. He pointed out that this is one of the biggest Planning Commission meetings this year.

COMMENTS OF THE CITY COUNCIL

Councilmembers Yourkowski, Marquardt and Ladd and no comments.

Councilmember Kranich humorously voiced concern that the wrong message is being sent to the new Councilmember with the Regular meetings getting over so soon.

Councilmember Cue thanked the Mayor for the proclamation regarding the Animal Shelter appreciation week. She voiced a reminder of how important it is to keep in mind the work that the people at the animal shelter accomplish on a day to day basis. She commented that this appreciation is touching in that a variety of issues are discussed, in the proclamation, as far as the work performed at the shelter in the Homer community and communities around the nation. She thanked the Homer Animal Friends and the volunteers at the Homer Animal Shelter for their work.

Councilmember Fenske ditto Councilmember Cue's comments, adding that the efforts by the people at the animal shelter are appreciated. He concluded that he had been encouraged to keep his comments short, because of football on Monday nights.

ADJOURNMENT

There being no further business to come before the Council the meeting was adjourned at 7:53 p.m. The next regular meeting is scheduled for November 27, 2000 at 7:30 p.m. A budget worksession is scheduled for Monday, October 30, 2000 at 6:00 p.m. The November 13th Regular Meeting is canceled. A budget worksession is scheduled for 6:00 p.m. on November 27th, if needed. A budget worksession is also scheduled for Wednesday, November 29th at 7:30 p.m.
