ORDINANCE 00-13(S)



AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HOMER, ALASKA, AUTHORIZING THE CITY MANAGER TO PURCHASE LOT 12-A, BUNNELL SUBDIVISION NO. 17, FOR THE AMOUNT OF $38,000 AND DESIGNATING THIS PARCEL FOR PUBLIC PURPOSE.



WHEREAS, Lot 12-A, Bunnell Subdivision No. 17, is needed for a public purpose for water, sewer and road connections; and



WHEREAS, the purchase of Lot 12-A, Bunnell Subdivision No. 17, is essential to the construction of the Harrington Heights water and sewer improvement district; and



WHEREAS, extending the existing street right-of-way through Lot 12-A, Bunnell Subdivision No. 17, would provide more efficient traffic circulation to and from the Harrington Heights neighborhood; and



WHEREAS, the extension of the street right-of-way would also facilitate better emergency service access to the Harrington Heights area; and



WHEREAS, HCC 18.06 provides for Municipal Property Acquisition and sets forth the authority, form and procedures; and



WHEREAS, the seller will satisfy the title insurance requirement of HCC §18.06.020(b) title report of HCC §18.06.020(c); and



WHEREAS, HCC §18.06.020(c) requires either the borough tax assessment value or an appraisal, the borough tax assessment value is $37,000; and



WHEREAS, the seller's price to the City of Homer is $38,000.

NOW, THEREFORE, THE CITY OF HOMER ORDAINS:



Section 1. The City Manager is authorized to purchase Lot 12-A, Bunnell Subdivision No. 17, in the amount of $38,000. This parcel is located to the west of Bartlett Avenue and to the east of Spruceview Avenue and more particularly described as:



Assessor's Parcel No. 175-133-2900

The seller and last known record owner of the property is Morton Family Trust, 6100 Lost Spring Rd, Reno, NV 89510-9511, according to the Borough assessment roll.



The City of Homer hereby finds that this parcel is required for a public purpose for water, sewer and road connections.



Section 2. The sum of $38,000.00 is hereby appropriated from the Homer Accelerated Water and Sewer Program Funds to the following account in the respective amount:



Account #153 5904 375 Description: Purchase of Lot 12-A Bunnell Sub. No. 17 Amount $38,000.00



Section 3. This ordinance amends the 2000 Budget and shall become effective immediately upon enactment and is a non code ordinance.
