AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HOMER, ALASKA, REPEALING HOMER CITY CODE 10.04.070, CITY DOCKS -- PROHIBITED USAGE.

WHEREAS, Homer City Code section 10.04.070, is obsolete, not warranted and the City Attorney sees no reason to retain this section; and

WHEREAS, this section used to read, as noted in attached Ordinance 71-11: "Use of the Homer City Dock by private individuals for non-commercial purposes is prohibited during any period of time that such dock, may be in use by any commercial interest"; and

WHEREAS, Ordinance 88-2 deleted the last part of the section: "... during any period of time that such dock, may be in use by any commercial interest", and Ordinance 95-18(S) repeated the same revised section.

NOW THEREFORE, THE CITY OF HOMER ORDAINS:

Section 1. Homer City Code section 10.04.070 is hereby repealed:

10.04.070 City docks -- Prohibited use. Use of the Homer City docks by private individuals for noncommercial use is prohibited. (Ord. 95-18(S) (part), 1995; Ord. 88-2 (part), 1988.)

Section 2. This ordinance is of a general and permanent character and shall be included in the Homer City Code.
