ORDINANCE 01-30

AN ORDINANCE OF THE CITY OF HOMER AMENDING HOMER CITY CODE SUB SECTION 1.24.040 (H), BYLAWS FOR COUNCIL PROCEDURES, QUORUM; VOTING AND AMENDING THE CITY COUNCIL'S OPERATING MANUAL TO REFLECT THE CHANGE IN THE COUNCIL'S BYLAWS.

WHEREAS, Roberts Rules of Order addresses the adoption of a motion or action without a motion, by unanimous (or general) consent; and

WHEREAS, the Homer City Council's Bylaws and Operating Manual do provide for consensus voting, but not for ordinances, resolutions or substantive motions; and

WHEREAS, the Council's Bylaws do provide for the Mayor to state the consensus of the Council without a motion and roll call vote, but not on Ordinances, Resolutions or Substantive motions.

THE CITY OF HOMER HEREBY ORDAINS:

Section 1. Section 1.24.040 (h)020 of the Homer City Code is hereby amended to read as follows:

h. Quorum; Voting:. Four Councilmembers shall constitute a quorum. Four affirmative votes are required for the passage of an ordinance, resolution, or motion. A member of the Council acting as Mayor Pro Tem shall not lose his vote as the result of service in such office. The Mayor is not a Councilmember and may vote only in the case of a tie. The final vote on each ordinance, resolution, or substantive motion is a recorded roll call vote may be a roll call vote or may be done in accordance with 1.24.040(k) ; ⁽¹⁾

Section 2. The appropriate amendments shall be made in the Council's Operating Manual to reflect this amendment to the Council's Bylaws.

Section 3. This ordinance is of a general and permanent nature and shall be included in the City Code.
