ORDINANCE 01-31

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HOMER, ALASKA, AUTHORIZING THE PURCHASE OF PARCEL 3, OF LOT 45A COAL BAY SUBDIVISION FROM THE MENTAL HEALTH LAND TRUST FOR THE CONSTRUCTION OF THE KACHEMAK BAY MULTI PURPOSE OCEAN DOCK (PIONEER DOCK) IN THE AMOUNT OF $3,000.00, AND AUTHORIZING THE CITY MANAGER TO EXECUTE THE APPROPRIATE DOCUMENTS.

WHEREAS, Parcel 3 is adjacent to the proposed Ferry Terminal property and is needed to complete the construction of the Kachemak Bay Multi Purpose Ocean Dock (Pioneer Dock); and

WHEREAS, the purchase price offered by the Mental Health Land Trust is $3,000; and

WHEREAS, HCC 18.06 provides for Municipal Property Acquisition and sets forth the authority, form and procedures.

NOW, THEREFORE, THE CITY OF HOMER ORDAINS:

Section 1. The City Manager is authorized to purchase Parcel 3 of Lot 45A, Coal Bay Subdivision, in the amount of $3,000. This parcel is located adjacent to the proposed Ferry Terminal Property and on the West side of the Homer Spit Road and more particularly described as:

Assessor's Parcel No. 181-034-4700, a portion lying north east on the eastern side

Area: 3,680 square feet

Parcel 3 within Lot 45A, Coal Bay Subdivision, a portion lying on the north east of the eastern side of Lot 45A

Adjacent to the proposed Ferry Terminal Property and to the east of the Homer Spit Road

The City of Homer hereby finds that this parcel is required for construction of the Kachemak Bay Multi Purpose Ocean Dock (Pioneer Dock).

Section 2. The sum of $3,000.00 will be expended from the project funds.

Section 3. That the City Manager is authorized to execute the appropriate documents.

Section 4. This ordinance is a budget amendment only, is not of a permanent nature and is a non code ordinance.
