ORDINANCE 01-33

AN ORDINANCE OF THE HOMER CITY COUNCIL APPROVING THE INTERIM AGREEMENT WITH THE KENAI PENINSULA BOROUGH TO PROVIDE FIRE AND EMERGENCY SERVICES, ACCEPTING AND APPROPRIATING $106,227 FOR THESE SERVICES, AND AUTHORIZING THE CITY MANAGER TO EXECUTE THE APPROPRIATE DOCUMENTS.

WHEREAS, the Kenai Peninsula Borough formed the Kachemak Emergency Service Area (KESA) to provide fire and emergency medical services and the City of Homer, KESA and the Kenai Peninsula Borough (KPB) have since negotiated terms by which the City of Homer would continue to provide services to the affected area at least on a temporary basis; and

WHEREAS, the KESA Board unanimously approved the six month contract on June 28, 2001; and

WHEREAS, the KESA Board approved a revised budget that provides funding for the contract with the City of Homer and which was subsequently approved by the KPB Assembly, in Ordinance 2001-19-07; and

WHEREAS, it is in the City of Homer's best interest to approve said contract; and

WHEREAS, the City should accept said $106,227.00 and appropriate these funds to account 100-4602-03 Fire Contract (KES); and

WHEREAS, this Ordinance is supported by the attached "Interim Agreement For Provision of Fire and Emergency Services", Memorandum dated July 9, 2001 from KPB Mayor Dale Bagley to Timothy Navarre, KPB Assembly President, KPB Ordinance 2001-19-07, KPB Amended Budget for KES, and, Memorandum from the City Manager.

NOW, THEREFORE, THE CITY OF HOMER ORDAINS that:

Section 1. The Interim Agreement For Provision of Fire And Emergency Services dated July 9, 2001, effective July 1, 2001, between the City of Homer and the KPB is approved.

Section 2. The $106,227.00 payment from the Borough is hereby accepted and shall be appropriated to account no. 100-4602-03 Fire Contract (KES).

Section 3. This ordinance is a budget amendment only, is not of a permanent nature and is a non code ordinance.
