ORDINANCE 01-44

AN ORDINANCE OF THE CITY COUNCIL OF HOMER, ALASKA, APPROPRIATING FUNDING FOR THE EMERGENCY ROOF REPAIRS FOR THE HOMER PUBLIC LIBRARY FROM THE GENERAL FUND IN THE AMOUNT OF $5,000.00, AUTHORIZING CHANGE ORDER #1 TO AM SERVICES IN THE AMOUNT OF $8,800.00 AND AUTHORIZING THE CITY MANAGER TO EXECUTE THE APPROPRIATE DOCUMENTS.

WHEREAS, during the Homer Public Library Stain, Repair and Roof Rehabilitation project the contractor reported to the Public Works Department that the Library roof was in need of greater repair then were included within his contract's scope of work; and

WHEREAS, upon inspection by the Public Works Director and Engineering Technician the determination was made that the roof situation at the Homer Public Library is an emergency situation requiring immediate attention in that failure was eminent; and

WHEREAS, AM Services provided a quote for the emergency repairs in the amount of $8,800.00, which is found to be a very responsive and responsible price quote by the Public Works Director and Engineering Technician; and

WHEREAS, this will require a change order to the AM Services Contract in the amount of $8,.800.00 thereby increasing the overall contract amount from $9,100 to $13,900.00; and

WHEREAS, the Library Reserve Account does not contain the funding necessary for the emergency repairs and, pursuant to the Finance Director's recommendation, requires an additional $5,000 to fund the emergency roof repairs.

NOW, THEREFORE, the City of Homer ordains:

Section 1. That funds are hereby appropriated for the Homer Public Library emergency roof repairs as follows:

Section 2. That Change Order Number 1. to the AM Services Contract is authorized in the amount of $8,800.00 and that the City Manager is authorized to execute the appropriate documents.

Section 3. This ordinance is an emergency ordinance pursuant to Homer City Code Section 1.08.040, is a budget amendment, is not of a permanent nature and is a non code ordinance.
