AN ORDINANCE OF THE CITY
COUNCIL OF HOMER, ALASKA AMENDING SECTION 21.48.030 OF THE HOMER ZONING CODE TO
DESIGNATE LARGE DEVELOPMENTS, OR HIGH PERCENTAGE LOT COVERAGE AS CONDITIONAL
USES IN THE CENTRAL BUSINESS DISTRICT.
WHEREAS, HCC 21.48.010
states that the Central Business District shall be designed to encourage
pedestrian movement and avoid traffic congestion; and
WHEREAS, HCC 21.48.010
states that the Central Business District should be characterized by ample and
convenient off-street parking, and safe and limited access to major streets;
and
WHEREAS, HCC 21.48.010
states that Central Business District buildings and other structures should be
compatible with one another and with the surrounding area; and
WHEREAS, Currently
permitted uses which may be incompatible in design or scale with other
permitted uses should be designated for public review; and
WHEREAS, Current
regulations permit the coverage of nearly an entire lot with a building; and
WHEREAS, Public review
should occur when lot coverage by a building (HCC 21.32.205 Floor area ratio)
exceeds what may be compatible with the surrounding area; and
WHEREAS,
Current parking regulations only address the required number of spaces and the
arrangement of those spaces; and
WHEREAS,
Large parking areas should be subject to public review and designed to lessen
their visual impact with buffers and landscaping; and
WHEREAS,
Permitted uses which will generate a large amount of traffic will create extra
stress on the public and public facilities, and should be subject to public
review; and

WHEREAS,
fostering development which is compatible with surrounding land uses is a
benefit to adjacent land owners and to the welfare of the community as a whole.
NOW,
THEREFORE, THE CITY OF HOMER HEREBY ORDAINS:
Section 1. Section 21.48.030 of the Homer City Code, which sets forth
the conditional uses in the Central Business District zoning district, is
hereby amended to read as follows:
21.48.030
Conditional uses and structures. The following uses are permitted in the central
business district when authorized in accordance with Chapter 21.61:
a. Planned unit developments;
b. Indoor recreational facilities such as
bowling alleys, skating rinks or similar uses;
c. Mobile home parks;
d. Service stations and other drive-in
establishments;
e. Public utility facilities and
structures;
f. Pipeline and railroads;
g. Heliports;
h. Greenhouses and garden supplies;
i. Incidental
and/or custom manufacturing, repair, fabricating, and/or assembly, provided
such use, including storage of materials, is wholly within an enclosed
building;
j. Shelter
for the homeless, provided such shelter does not abut an urban, rural or office
residential zoning district;
k. More than one building containing a
permitted principal use on a lot.

l. Group care homes.
m. Drive-in car washes, but only on the
Sterling Highway from Tract A-1 Webber Subdivision to Heath Street, subject to
the provisions of conditional use permits, HCC Chapter 21.61. (Ord. 98-13(S),
1, 1998; Ord. 95-21(S) 24, 1995; Ord. 91-18(A)21, 1991; Ord. 90-25(part), 1990;
Ord. 89-20 (part), 1989; Ord. 88-6(S)(part), 1988; Ord. 86-35 (part), 1986;

n. Permitted uses with structures in excess of 8,000 square
feet of building area or a building area in excess of 30% of the lot area.
Section 2. This
ordinance is of a permanent and general character and shall be included in the
City Code.
