ORDINANCE 02-27
AN ORDINANCE OF THE CITY OF HOMER AMENDING HOMER CITY CODE CHAPTER 13.04 CONCERNING DEFINITIONS FOR STANDARD CONSTRUCTION PRACTICES, AMENDING SECTION 13.08.010 CONCERNING THE APPLICABILITY OF CHAPTER 13.08, AND REPEALING IN ENTIRETY SECTIONS 13.40.010 THROUGH 13.40.320 AND REENACTING A NEW SECTION 13.40.010 CONCERNING STANDARD CONSTRUCTION SPECIFICATIONS.
WHEREAS, The City of Homer, since 1988 has used the City of Homer Standard Construction Specifications, which includes General Provisions, Construction Specifications and Standard Details; and
WHEREAS, The Standard Details contained with the Standard Construction Specifications have been revised and are current; and
WHEREAS, The Standard Details in Sections 13.40.010 through 13.40.320 have not been updated; and
WHEREAS, The City of Homer requires that General Contractors own the City’s Standard Construction Specifications for road, water, sewer and other projects; and
WHEREAS, HCC 13.04.100 defines the City Standard Construction Specifications as a set of construction specifications approved by the City of Homer for general application and repetitive use.
NOW, THEREFORE, THE CITY OF HOMER HEREBY ORDAINS:
Section 1. Homer City Code Section 13.04.010 is hereby amended to read as follows:
13.04.010 Applicability. As
used in Title 13, unlessUnless otherwise provided, or the
context otherwise requires, the words and phrases set out in this chapter shall
have the meaning set forth in this chapter.

Section 2. Homer City Code Section 13.04.100 is hereby amended to read as follows:
13.04.100 City standard specifications. "City standard specifications"
means a set of construction specifications and
standard details approved by the City of Homer for general
application and repetitive use
approved pursuant to section 13.40.010.
Section 3. Homer City Code Section 13.08.010 is hereby amended to read as follows:
13.08.010 Applicability. This
chapter and the City standard
specifications standard specification covers the requirements,
materials and standard practices to be followed in apply to the construction of roads, utilities, driveway and roadside drainage projects
within the public rights-of-way (R.O.W.).
a. Any person proposing work in the right-of-way or connecting to a City utility shall obtain a permit from the City of each individual project. Permits shall be available at City Hall Planning Department.
b. A permit fee for each permit
shall be paid upon issuance of the particular permit. Fees are five dollars
for the issuance of a permit only and twenty-five dollars for a permit where
plans and specifications are required.
Permit fees shall be set by Resolution of the City Council.
Section 4. Homer City Code Sections 13.40.010 through 13.40.320 are here by repealed in entirety and a new Section 13.40.0101 is enacted to reads as follows:
13.40.010
Standard Construction Specifications and Standard Details. a. The Standard Construction Specifications and
the Standard Details developed and maintained by the Director of Public Works
and approved by the City Manager shall
apply to all construction of roads, utilities, driveways, and roadside drainage
projects in the public rights-of-way unless otherwise provided by code, permit
or contractual provision.
b.
The Standard Construction Specifications and the Standard Details may be
revised or amended from time to time by the Director of Public Works with the
written approval of the City Manager.
All approved revisions and amendments will be forwarded to the City
Clerk for filing in the records of the City.

c.
The official current version of the Standard Construction Specifications
and the Standard Details will be kept and maintained in the office of the City
Clerk, with a duplicate of the official current version to be kept and
maintained in the office of the Director of Public Works. Two copies shall be maintained and made
available for public review during business hours at the Department of Public
Works.
Section
5. This ordinance is of a permanent and general
character and shall be included in the City Code.
