                                                             ORDINANCE 02-41

 

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HOMER, ALASKA, ACCEPTING CERTAIN TAX-FORECLOSED PROPERTY, PARCELS 177-177-0600 AND 177-177-0780, DEEDED TO THE CITY BY THE KENAI PENINSULA BOROUGH AND DESIGNATING AS UNDESIGNATED

 

WHEREAS, Following action on the 2001 Kenai Peninsula Borough tax foreclosure of delinquent 1999 real property tax liens, the Kenai Peninsula Borough has deeded certain property located within the City of Homer to the City; and

 

WHEREAS, The Clerk=s Deed was obtained from the Homer Recorder’s Office September 2002 by the Homer City Clerk’s Office; and

 

WHEREAS, Council took action on Memorandum 02-47 on September 23, 2002 to bring forward an Ordinance pursuant to the provisions of Title 18 of the Homer City Code and Alaska Statute 29.45.460 that parcels 177-177.0600 and 177-177-0780 be retained for a public purpose and classified as Aundesignated@.

 

NOW THEREFORE, THE CITY OF HOMER ORDAINS:

 

Section 1. The City of Homer accepts the following foreclosed property located on Ocean Drive Loop and more particularly described as:

 

Kenai Peninsula Borough Assessor=s Parcel No. 177-177-0600

Lot Forty-Three (43), Oscar Munson Subdivision

Kenai Peninsula Borough Assessor’s Parcel No. 177-177-0780

            Lot Forty-Four (44), Oscar Munson Subdivision

According to Plat No. 3415 recorded in 1957, recorded in Homer Recording District, Third Judicial District, State of Alaska.

 

The last known record owner of the property according to the Borough assessment rolls is

Burt A. and Bobbie L. Barr, P.O. Box 8309, Nikiski, AK   99635-8309.

 

The City of Homer hereby finds that this parcel shall be retained for a public purpose and classified as Aundesignated@ and that all rights of the prior record owner or their assigns shall cease upon the enactment of this Ordinance pursuant to the provision of Title 18 of the Homer City Code.

 

Pursuant to the requirements of A.S. 29.45.490, the City shall satisfy unpaid Kenai Peninsula Borough taxes and assessments against the property, with accrued interest but without penalty.

 

Section 2.  Pursuant to the requirements of A.S. 29.45.460, within five days after the first

publication of the notice of public hearing on this ordinance, the City Clerk or her designee shall send a copy of the hearing notice to the former record owner of the property identified in this ordinance.

Section 3.  This is a non code ordinance and shall become effective upon adoption.
