                                                             ORDINANCE 02-44

 

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HOMER, ALASKA, AMENDING HOMER CITY CODE SECTION 21.69.020, PUBLIC HEARING PROCEDURES, TO PUBLISH NOTICE AT LEAST ONCE IN A PAPER OF GENERAL CIRCULATION.

 

WHEREAS, The Homer Advisory Planning Commission and Homer Planning and Zoning Department have had increasing publication deadline problems with the requirement to publish notice at least twice in a paper of general circulation; and

 

WHEREAS, The local papers are weekly and not daily; and

 

WHEREAS, State Statute requires that the last day of publication not be less than five days prior to the hearing; and

 

            WHEREAS, The Open Meetings Act requires reasonable notice to the public and the City meets this by mailing public notice of zoning type matters to property owners within a three hundred foot periphery of the parcel affected by the proposed action, by posting in at least three public places (City Hall, Public Library, Port/Harbor Office), is posted on at least the City Clerk’s internet site, is reported on the Clerk’s weekly radio report on KBBI, multiple copies are available at the five City Kiosks (City Hall Clerk’s Reception area, Eagle Quality Center, Ulmers, Barbara Village Texaco, Pudgy’s Meat Market) and the publication in a paper of general circulation.

 

NOW THEREFORE, THE CITY OF HOMER ORDAINS:

 

Section 1. The City of Homer hereby amends Homer City Code Section 21.69.020, Public Hearing Procedures to read as follows:

 

            21.69.020 Public hearing procedures. a. Notice of the public hearing shall be published at least twice once in a paper of general circulation within the City.  The notice shall be published during each of the two calendar weeks   a calendar week prior to the public hearing date.

b.         The notice shall contain at least the following information:

1.         A brief description of the proposal on which the public body is to act;

2.         A legal or common description of the property involved;

3.         Date, time and place of the public hearing;

4.         Person and place to contact for more detailed information.

c.         The rules of order of the body holding the hearing shall prevail.  (Ord. 82-15 '4 (part), 1982.)

 

            Section 2.   This ordinance is of a permanent and general character and shall be included in the City Code.
