ORDINANCE 03-59

AN ORDINANCE OF THE CITY COUNCIL OF HOMER, ALASKA APPROPRIATING THE ALASKA CLEAN WATER FUND LOAN IN THE AMOUNT OF $150,000.00 FOR THE WASTEWATER (SEWER) PORTION OF THE WATER AND WASTEWATER MASTER PLAN AND AUTHORIZING THE CITY MANAGER TO EXECUTE THE APPROPRIATE DOCUMENTS.

WHEREAS, Resolution 03-107, adopted by the City Council on August 11, 2003, authorized the application to the Alaska Department of Environmental Conservation (ADEC) for $150,000.00 for the wastewater portion of the Water and Wastewater Master Plan; and

WHEREAS, Loan eligibility approval was received from ADEC on August 26, 2003 with a loan agreement that was executed by the City Manager pursuant to Resolution 03-107; and

WHEREAS, The requested certification letter from the City Attorney regarding the City of Homer's legal authority to incur debt created by the ADEC Loan was submitted.

NOW, THEREFORE, BE IT ORDAINED by the City of Homer :

Section 1. The Alaska Clean Water Fund Loan money will be appropriated as follows and the City Manager is authorized to Execute the appropriate documents:

Section 2. This ordinance is a budget amendment only, is not of a permanent nature and is a non code ordinance.
