ORDINANCE 04-01




AN ORDINANCE OF THE CITY COUNCIL AMENDING HOMER CITY CODE SECTIONS 8.12.150, VEHICLE PERMIT-- TERM, ISSUANCE AND FEE; 8.12.200, CHAUFFEUR'S LICENSE -- REQUIRED.

WHEREAS, The City Council adopted Resolution 03-159 which amended the City of Homer Fee Schedule to set the fees for Annual Taxi Permit, Chauffeur' License and Annual Safety Inspection Commercial Vehicles; and

Annual Taxi Permit NEW $75

Chauffeur's License from $25 to $75

Annual Safety Inspection Commercial Vehicles from $25 to $100

WHEREAS, It is the Administration's and Council's intent that the Code reference the fee schedule where ever and when ever applicable; and

WHEREAS, An amendment is required to the fee schedule to incorporate the fee for a vehicle permit after January first and permit replacement fee; and

WHEREAS, The City of Homer Fee Schedule will typically be amended during the Budget Process.

NOW, THEREFORE, THE CITY OF HOMER ORDAINS:

Section 1. That HCC Section 8.12.150 is hereby amended to read as follows:

8.12.150 Vehicle permit--Term, issuance and fee. When satisfied the vehicle meets the requirements of safe operation for public transportation, the Chief of Police or his designee shall issue a vehicle inspection permit. The permit shall be valid for a one-year period or portion thereof, expiring on June thirtieth. The fee shall be twenty five dollars per vehicle unless the permit is applied for after January first, then the fee shall be twelve dollars and fifty cents per vehicle. The permit, which will be a sticker or decal, shall be displayed at all times from the front windshield of the vehicle. Vehicle permits are nontransferable from vehicle to vehicle. Replacement of lost vehicle permits may be obtained from the Homer Police Department for a fee of five dollars. Permit fee amounts shall be set by Council Resolution and set forth in the City of Homer Fee Schedule. (Ord. 96-05(A) §4, 1996; Ord. 85-7 §1 (part), 1985).

Section 2. HCC 8.12.200 is hereby amended to read as follows:

8.12.200 Chauffeur's license--Required. Anyone operating a public transportation vehicle upon the streets of the City shall first apply for, be issued and thereafter hold in effect a City chauffeur's license granted by the Homer Police Department.

a. To apply for, be issued and thereafter hold a Chauffeur's license, the applicant shall possess the following qualifications:

1. The applicant shall be nineteen years of age or older;

2. The applicant shall possess a current state driver's license;

3. The applicant shall not;

i. have been convicted of sexual offense;

ii. have been convicted of a felony involving a substance control under Alaska Statutes Title ll;

iii. have been convicted of a felony or misdemeanor involving a crime of violence;

iv. have been convicted of a felony and imprisoned under such convictions under sentences which were not concurrent;

v. have been convicted of any felony wherein any portion of the sentence imposed thereon existed within five years immediately preceding the application;

vi. have been convicted of a misdemeanor involving contributing to the delinquency of a minor;

vii. be currently charged or awaiting trial or other disposition under any of the foregoing offenses listed in this subsection.

b. The applicant shall provide documentation that he/she has, within the last thirty days, undergone physical examination conducted by a physician. Such physical examination shall meet the requirements set by the Kenai Peninsula borough for school bus operators.

c. The applicant shall consent to fingerprinting by the Homer Police Department.

d. The applicant shall pay a nonrefundable application fee of twenty-five dollars plus a fingerprint processing fee as set forth in Alaska Statutes 44.41.025(b), plus fingerprint and any other processing fees in the amount determined by Council resolution and set forth in the City of Homer Fee Schedule. administrative fee schedule. (Ord. 98-12, §1, 1998; Ord. 96-05(A) § 6, 1996; Ord. 85-7 §1 (part), 1985).

Section 3. This ordinance is a general ordinance of a permanent nature and shall be included in the City Code.
