ORDINANCE 04-04

AN ORDINANCE OF THE CITY COUNCIL AMENDING HOMER CITY CODE SECTIONS 14.04.055, SEWER CONNECTION AND EXTENSION PERMIT FEE, AND 14.08.035, WATER CONNECTION AND EXTENSION PERMIT FEE.

WHEREAS, The City Council adopted Resolution 03-159 which amended the City of Homer Fee Schedule, Planning and Zoning Department Fees, Right of Way Permit fees; and

WHEREAS, It is the Administration's and Council's intent that the Code reference the fee schedule where ever and when ever applicable; and



WHEREAS, The City of Homer Fee Schedule will typically be amended during the Budget Process.



NOW, THEREFORE, THE CITY OF HOMER ORDAINS:

Section 1. That HCC Section 8.12.150 is hereby amended to read as follows:

14.04.055 Sewer connection and extension permit fee. a. The sewer connection and extension permit fee shall include all inspection and administrative costs. All other fees for deferred services, in lieu of assessments and necessary right-of-way permits shall be in addition to the permit fee.

b. The sewer connection and extension permit fee shall be two hundred dollars an amount determined by Council Resolution and set forth in the City of Homer Fee Schedule. All sewer connections and extensions shall be inspected by the Public Works Department. The customer shall make arrangements with the Public Works Department at least twenty-four hours in advance for all required inspections.

c. The customer shall pay for any necessary right-of-way permit fees in an amount determined by Council Resolution and set forth in the City of Homer Fee Schedule. The fees are as follows:

Major City right-of-way permits involve the review of project plans and specifications. Additional permit fees may be charged at permit execution for special inspections or reviews.

d. The customer requesting a sewer connection or sewer extension which requires a deferred service, or in lieu of assessment payment, shall pay a fee as determined by The Finance Department. (Ord. 90-24(A), 1990.)



Section 2. HCC 14.08.035 is hereby amended to read as follows:



14.08.035 Water connection and extension permit fee. a. The water connection and extension permit fee shall include all inspection and administrative costs. All other fees for meter lease, deposit, deferred services, in lieu of assessments and necessary right-of-way permits, shall be in addition to the permit fee.

b. The water connection and extension permit fee shall be an amount determined by Council Resolution and set forth in the City of Homer Fee Schedule two hundred fifty dollars. All water connections and extensions shall be inspected by the Public Works Department. The customer shall make arrangements with the Public Works Department at least twenty-four hours in advance for all required inspections.

c. All water shall be metered. Generally, only one meter shall be issued to each lot for areas other than the Spit. The one time meter lease fee shall be the actual cost of the water meter installed plus fifteen percent as determined by the Public Works Director.

d. The customer shall pay for any necessary right-of-way permit fees in an amount determined by Council Resolution and set forth in the City of Homer Fee Schedule. These fees are as follows:

e. The customer requesting a water connection or water extension which requires a deferred service or in lieu of assessment payment, shall pay a fee as determined by the Finance Department.

f. A one-time fee for a pressure reducing valve (PRV), when required by 13.28.050(e), shall be actual costs plus fifteen percent as determined by the Public Works Director.

The City will maintain the pressure reducing valves. The customer shall pay for such maintenance only if the valve is damaged because the customer allowed it to freeze or as a result of negligent or intentional acts or omissions of the customer. Section 3. This ordinance is a general ordinance of a permanent nature and shall be included in the City Code.
