ORDINANCE 04-12(A)

AN ORDINANCE OF THE CITY COUNCIL APPROPRIATING$7,000 FOR STOCKING THE FISHIN' HOLE FROM THE GENERAL FUND FUND BALANCE AND AUTHORIZING THE CITY MANAGER TO EXECUTE THE APPROPRIATE DOCUMENTS.

WHEREAS, During the 2003 Budget process, via Ordinance 02-51(A), the City Council amended the budget to allocate $5,000.00 out of the Parks and Recreation Reserve Funding 151-385 for stocking of the Fishin' Hole; and

WHEREAS, Council's direction on December 9, 2002 was that this allocation was to be given upon confirmation that the Cook Inlet Aquaculture Association has received the rest of the funding for the raising of the smolt; and

WHEREAS, The total amount needed in 2003 was reported to be $25,000.00; and

WHEREAS, Nicky Szarzi, area biologist for the lower Cook Inlet with the Alaska Department of Fish and Game Sport Fish Division, advised the Council on February 23, 2004, that the Sport Fish Division in Homer is continuing to struggle with more demand for stocked fish than money or than hatchery assistance can provide for 2004; and

WHEREAS, The reported funds needed for 2004 are $50,000 to stock the Fishin' Hole, aka, Fishin'Lagoon; and

WHEREAS, The Fishin' Hole has been stocked since 1984 and until 2000 runs were coming back throughout the summer season; and

WHEREAS, Nicky Szarci reported that there were about 30,000 angler days in 2003 with a harvest of about 8,000 Salmon; and

WHEREAS, Council has noted the economic benefit to the community by fisherman at the Fishin' Lagoon.

NOW, THEREFORE, the City of Homer Ordains:

Section 1. That the$7,000 for stocking the Fishin' Hole is hereby appropriated as follows:

Expenditure Condition/Stipulation: That some procedure be enacted and created to generate revenue from the Fishin' Hole to help pay for the stock in the future, actually have something generated on the books for next year that shows where to get revenues from the people fishing in the Fishin' Hole. That the $7,000.00 be spent if the budget shows or if the audit shows that amount and if not the City Manager will find the money somewhere or find partners to help raise it; an either/or thing.

Section 2. That the City Manager is Authorized to execute the appropriate documents.

Section 3. This ordinance is a budget amendment only, is not of a permanent nature and is a non code ordinance.
