ORDINANCE 04-19

AN ORDINANCE OF THE CITY COUNCIL AUTHORIZING THE EXPENDITURE OF HOMER ACCELERATED WATER AND SEWER PROGRAM (HAWSP) FUNDS FOR KACHEMAK DRIVE PHASE ONE SEWER.

WHEREAS, Ordinance 99-14(S)(A), adopted by the Council and placed on the October 5, 1999 Regular Election; and

WHEREAS, The Voters passed the two propositions put before them via Ordinance 99-14(S)(A) on October 5, 1999 with an effective date of October 26, 1999; and

WHEREAS, The propositions amended Homer City Code 9.16.010(b) to rededicate current unexpended sales tax revenues collected to water and sewer improvements and further eliminated the current termination date of the tax and rededicated the entire tax to water and sewer systems improvements after satisfaction of sewer treatment plant debt retirement obligations; and

WHEREAS, Resolution 04-11, adopted by Council on January 12, 2004, Authorized the formation of the Kachemak Drive Phase One Sewer Assessment District at the 75% property owner share of Assessments; and

WHEREAS, Resolution 04-11 authorized the City Manager to proceed with the preparation and construction of the Kachemak Drive Phase One Sewer Project; and

WHEREAS, The Fiscal Note attached to Resolution 04-11 was: Estimated project cost is $644,800.00, total property owner assessments at 75%, $483,600.00 minus exemptions equals $384,400.00; and

WHEREAS, Resolution 04-32, adopted by Council on April 12, 2004, Awarded the Contract for professional engineering services for, in part, the Kachemak Drive Phase One Sewer project; and

WHEREAS, The Fiscal Note attached to Resolution 04-32 was: Fiscal Note: Kachemak Drive Phase I Sewer 215-826, Design Cost$40,551, Design Budget $63,300 and % of Construction 7.7%; and

WHEREAS, The Final project numbers will not be known until project completion and any increases to the property owner assessments must follow the process and procedures of Homer City Code 17.04.

NOW, THEREFORE, the City of Homer Ordains:

Section 1. That use of the HAWSP Funds is hereby authorized for the Kachemak Drive Sewer Project as follows:
