ORDINANCE 04-25

AN ORDINANCE OF THE CITY COUNCIL AMENDING HOMER CITY CODE SUB SECTION 21.48.040(E)(1), CENTRAL BUSINESS DISTRICT, BUILDING AREA AND DIMENSIONS - RETAIL AND WHOLESALE - SIZE FROM 35,000 SQUARE FEET TO 42,000 SQUARE FEET; AMENDING HOMER CITY CODE SUB SECTIONS 21.49.040(E)(2)(3), GENERAL COMMERCIAL ONE, BUILDING AREA AND DIMENSIONS - RETAIL AND WHOLESALE SIZE TO 55,000 SQUARE FEET AND 25,000 SQUARE FEET.

Whereas, It is recognized that Homer is a growing community, and development on a scale that matches the needs of the community while preserving the unique character of the community will facilitate diverse long term economic growth; and

Whereas, The right "fit" for Homer will promote a healthy local economy and enhance the quality of life in Homer; and

Whereas, Promoting balanced growth on a level playing field at a size that will encourage competition, will also encourage a diverse local economy, encourage local businesses to expand, and therefore add jobs to the community.

NOW, THEREFORE, THE CITY OF HOMER ORDAINS:

Section 1. Homer City Code Sub Section 21.48.040(e)(1) is hereby amended to read as follows:

21.48.040(e)(1) Building Area and Dimensions - Retail and Wholesale.

1. The total square feet of floor area of retail and wholesale business uses within a single building shall not shall not exceed 35,000 42,000 square feet

Section 2. Homer City Code Sub Sections 21.49.040(e)(2) and (3) are hereby amended to read as follows:

21.49.040(e)(2) and (3) Building Area and Dimensions - Retail and Wholesale.

2. In that area east of Alder Lane, identified as the East Road GC1: the total square feet of floor area of retail and wholesale business uses within a single building shall not shall not exceed45,000 55,000 square feet.

3. In that area west of Baycrest Park, identified as Scenic Gateway GC1: the total square feet of floor area of retail and wholesale business uses within a single building shall not shall not exceed20,000 25,000 square feet.
